In a progressive step aimed at preserving human dignity and upholding justice, the Sharjah Judicial Council has approved new rules regarding the imprisonment of defaulting debtors.

Under the newly implemented decision, debtors will not face jail time without a thorough investigation first.

The decision, which has been made in line with the directives of His Highness Sheikh Dr. Sultan bin Muhammad Al Qasimi, Member of the Supreme Council and Ruler of Sharjah, ensures that any decision to imprison a defaulting debtor will only be made after a brief but fair investigation. During this investigation, creditors will be required to demonstrate the debtor’s ability to pay the debt, or prove that the debtor is intentionally hiding assets or failing to make payments without a legitimate reason.

The aim of these measures is to balance justice with compassion, ensuring that debtors are not unjustly penalised while also maintaining accountability for those who deliberately evade their financial responsibilities. The changes reflect Sharjah’s ongoing commitment to improving its legal framework while considering both the rights of creditors and the dignity of debtors.

In addition to the new regulations, the Sharjah Judicial Council has directed the Public Prosecution to work closely with relevant government agencies, especially those involved in family and social affairs. The goal is to address disputes in an amicable manner, encouraging parties to reconcile before any formal lawsuits are filed or escalated to court.

The recent meeting also included discussions on a number of initiatives, including updates on the joint committee’s progress with the Ministry of Justice to transition to local staff. This move is part of Sharjah’s broader strategy to enhance the judicial system and improve the efficiency of legal processes.

The meeting was presided over by Sheikh Sultan bin Ahmed bin Sultan Al Qasimi, tDeputy Ruler of Sharjah and Chairman of the Judicial Council, at the House of Wisdom.

Through these reforms, Sharjah continues to position itself as a model for a fair and balanced legal system, ensuring that justice is served without compromising the dignity of its residents.
