Bahrain: Ex-Employee Ordered To Return BD174,000 Pension Benefits After Reinstatement

An ex-employee of the General Organisation for Social Insurance (GOSI) has been ordered to reimburse BD174,000 he received as pension benefits after being terminated, securing a reinstatement order valid from the date of termination.

The court ruled that his period of service was deemed continuous without any breaks, as there was no interruption in his employment.

The case began in 2010, when GOSI terminated the employee after the department was dissolved following a merger with the pension fund.

The termination resulted in GOSI paying the employee a pension and other benefits exceeding BD180,000.

In 2019, the defendant secured a reinstatement order, calculating the period from termination to the re-joining date as a working period with full benefits.

The court ordered BD60,000 in compensation, citing moral and material damages he suffered.

GOSI argued that the reinstatement order made the benefits paid at the time of termination recoverable, which the appeals court accepted.

The court explained that the pension benefits are recoverable, as the employee received BD60,000 in compensation for the 10 years he remained without a job.
