Bahrain: Court rules in favour of heirs over property gifted 17 years ago

A long-drawn-out legal battle over a property transferred as a gift by a father to his five children ended with the Court of Cassation confirming the deed’s legal validity.

The decision came in a case that contested the children’s right to the property they inherited 17 years ago from their father as a gift.

Court files say the children inherited the property from their father when they were minors.

However, a legal objection was raised against the transfer of the property, citing that the property was still in their late father’s name.

The defendants’ lawyers told the court that the plaintiffs were living on the property long before receiving it as a gift.

The property and the house the children continue to live in were given as a gift to them in 2003.

In 2010, their father passed away.

The lawyers also pointed out that the gift decision is valid as per Resolution No. 3/2017 for issuing documents.

Ruling in favour of the defendants, the court said the father had bequeathed his property to his heirs before his death.

“None have the right to object to this action, as he had bequeathed the property, fully owned by him, as per his wish.”

The court also ruled that the father’s decision was legally valid.

Judges further ruled that the contract in question is valid and enforceable
